CONCERNING
ACTIONS AND CONDITIONS OF QUARANTINE PLANT
FOR THE ENTRY OF PLANT AND SEEDLING
INTO THE TERRITORY OF THE REPUBLIC OF INDONESIA, LASTLY AMENDED BY THE DECREE OF THE MINISTER OF AGRICULTURE

Attachment

Considering:

• a. that by the Decree of the Minister of Agriculture No. 38/Kpts/ HK.310/I9/1990, there has been stipulated Conditions and Actions of Quarantine Plant for the Entry of Plant and Seedling into the Territory of The Republic of Indonesia;
• b. that the Appendix III of the l Decree of the Minister of Agriculture No. 38/Kpts/HK.310/I/1990 concerning Importing and Exporting Places for the hampering organism carrier medium for quarantine plant, lastly amended through the Decree of the Minister of Agriculture No. 211/Kpts/HK.310/4/2001;
• c. that the execution of agricultural quarantine in all Technical Execution Units spreading throughout the regions of the Republic of Indonesia has experienced a very quick development, consequently to anticipate the aforesaid development and also to improve fluency of quarantine activities in the field, it is necessary to make an addition of importing and exporting places for seeds and plant Into the Region of the Republic of Indonesia, as meant in the Appendix of the Decree of the Minister of Agriculture of the Republic of Indonesia No. 211/Kpts/HK.310/4/2001;
• d. that by virtue of the aforementioned matters, it is considered necessary to re-determine Places of Entry For Plant and Seed Plant Into the Territory of the Republic of Indonesia.

In View of:

• 1. The Law No. 16/1992 concerning Animal , Fish and Plant Quarantine (The State Gazette /Governmental Gazette of 1992 No. 56, the Additional State Gazette No. 3482);
• 2. The Governmental Regulation No. 82/1999 concerning Sea Transportation (The State Gazette of 1999 No. 187, The Additional State Gazette No. 3907);
• 3. The Presidential Decree No. 228/MK/2001 concerning Establishment of The Gotong Royong (Mutual Assistance) Cabinet;
• 4. The Presidential Decree No. 165/2000 and the Presidential Decree No. 177/2000 and the Presidential Decree No. 37/2001 concerning Position, Task, Function, Authority and Composition of Organization and the Work Procedure of Department;
• 5. The Joint Decree among the Minister of Trade, the Minister of Communications and the MINISTER of Finance No. 885/Kpb/VII/1985, No. KM/139/HK.205/Phb.85 and No. 677/KMK/05/1985 concerning Seaport and Airport Open for International Trade;
• 6. The Decree of the MINISTER of Justice and Human Rights No. M.06.Pw.09.07.hk.2000 concerning the Fourth Amendment of the Decree of the Minister of Justice of The Republic of Indonesia No. M.06/PW.09.02/1995 concerning Immigration Inspecting Places:
• 7. The Decree of The MINISTER of Communications No. KM/51/1989 connected with the Decree of the Minister of Communications No. KM/22/1999 concerning Organization and work procedure of Administrator Office of Container Terminal at Jebres Surakarta-Solo;
• 8. The Decree of the Minister of Agriculture No. 422/Kpts/LB.730/6/1988 concerning Animal Quarantine Regulation;
• 9. The Decree of the Minister of Agriculture No. 01/Kpts/OT.210/1/2001 in conjunction to the Decree of the Minister of Agriculture No. 354.1/Kpts/OT.210/6/2001 concerning Organization, Work Procedure of the Department of Agriculture;

HAS DECIDED:

To stipulate:

THE DECREE OF THE MINISTER OF AGRICULTURE CONCERNING AMENDMENT ON THE APPENDIX III OF THE DECREE OF THE MINISTER OF AGRICULTURE No. 38/Kpts/HK.310/1/1990 CONCERNING CONDITIONS AND ACTIONS OF PLANT QUARANTINE FOR THE ENTRY OF PLANT AND SEEDS INTO THE TERRITORY OF THE REPUBLIC OF INDONESIA, LASTLY AMENDED BY THE DECREE OF THE MINISTER OF AGRICULTURE No. 211/KPTS/HK.310/4/2001.

Article 1

1. To amend the Appendix III of the Decree of the Minister of Agriculture No. 39/Kpts/HK.310/1/1990, lastly amended by the Decree of the Minister of Agriculture No. 211/KPTS/HK.310/4/2001, consequently it shall be as contained in this Appendix.

2. Other provisions stipulated in the Decree of the Minister of Agriculture No. 38/Kpst/HK.310/1/1990 are declared to remain valid/effective.

3. By the issuance of this Decree of the Minister of Agriculture, then the Decree of the Minister of Agriculture No. 211/Kpts/HK.310/4/2001 is declared to be invalid anymore.

Article 2

This Decree shall take into effect as of the date of issuance.
